1. Acceptance of Terms
By purchasing a membership, enrolling in a program, using the Fit-N-Wise facility, or accessing this website, you agree to be bound by these Terms and Conditions. These terms apply to all members, guests, program participants, and website visitors. If you do not agree, please do not use our services.
2. Memberships
- → Memberships are personal and non-transferable. Sharing access credentials or keycards is prohibited.
- → Members must check in at the front desk upon each visit.
- → Fit-N-Wise reserves the right to modify membership pricing with reasonable advance notice.
- → Membership benefits and facility hours are subject to change. We will provide notice of significant changes.
- → Fit-N-Wise may suspend or terminate a membership for violation of these terms, facility rules, or conduct that endangers staff or members.
3. Payment Terms
- → Membership dues are billed monthly or annually as selected at enrollment. By providing payment information, you authorize Fit-N-Wise to charge recurring dues.
- → Failed payments may result in suspension of facility access until the balance is resolved.
- → All fees paid are non-refundable except as required by applicable law or as described in our cancellation policy.
- → Drop-in passes, class packages, and add-on services must be used within the period stated at purchase.
4. Cancellation Policy
- → Members wishing to cancel must provide 30 days' written notice before the next billing date. Cancellation requests must be submitted in person at the front desk or in writing to fitnwise@healthywiseco.org.
- → For class and appointment cancellations, please provide at least 24 hours' notice. Late cancellations and no-shows may be charged the full session fee.
- → Medical holds may be available with documentation from a licensed healthcare provider. Contact the front desk to request a hold.
5. Facility Rules and Code of Conduct
- → Members and guests must treat staff and other members with respect. Harassment, threatening behavior, or discrimination of any kind will result in immediate termination of membership.
- → Appropriate athletic attire and closed-toe shoes are required in fitness areas. Pool areas require appropriate swimwear.
- → Equipment must be wiped down and returned to its proper location after use.
- → Photography and video recording of other members without their consent is strictly prohibited.
- → Use of the facility under the influence of alcohol or drugs is prohibited.
- → Minors under 14 must be accompanied by a parent or guardian in all areas except the Child Center and designated youth programs.
6. Pool Rules
- → Shower before entering the pool. No street clothing in the pool.
- → No running on pool decks. No diving in shallow areas.
- → Children who are not water-safe must be within arm's reach of a parent or guardian at all times.
- → Lap lanes are designated for lap swimming during lap swim hours. Please share lanes courteously.
- → Pool hours and availability are subject to change for events, maintenance, and swim team practices.
7. Child Center
- → Child Center is available to members with children ages 6 weeks to 12 years while the parent or guardian is actively using the facility.
- → Maximum stay is 2 hours per visit. Parents must remain on the Fit-N-Wise premises at all times while their child is in the Child Center.
- → Children with signs of illness (fever, vomiting, contagious conditions) may not use the Child Center.
- → Emergency medications must be provided by parents with written authorization for staff to administer.
8. Assumption of Risk and Liability Waiver
Physical activity involves inherent risks, including but not limited to muscle strains, joint injuries, cardiovascular events, and accidental injury from equipment. By using Fit-N-Wise facilities and services, you acknowledge and accept these risks.
TO THE FULLEST EXTENT PERMITTED BY LAW, you agree to release, waive, and discharge Fit-N-Wise, Wise Regional Health System, their officers, employees, agents, and volunteers from any and all liability for injury, loss, or damage arising from your use of the facility, participation in programs, or any other activity on the premises.
You represent that you are in adequate physical condition to participate in fitness activities and that you have consulted with a healthcare provider if you have any medical condition that may be affected by physical exercise. If you experience pain, dizziness, shortness of breath, or any unusual symptoms, stop exercising immediately and seek medical attention.
9. Personal Property
Fit-N-Wise is not responsible for lost, stolen, or damaged personal property. Members and guests are advised not to bring valuables to the facility. Lockers are provided as a convenience and do not guarantee the security of contents.
10. Photography and Media
By using Fit-N-Wise facilities, you grant Fit-N-Wise permission to photograph or record you for promotional and marketing purposes unless you have submitted a written opt-out request. Images or videos in which you appear may be used on our website, social media, and print materials.
11. Modifications to Terms
Fit-N-Wise reserves the right to modify these Terms and Conditions at any time. Updated terms will be posted on this page and, where appropriate, communicated to active members via email. Continued use of our services after changes take effect constitutes acceptance of the revised terms.
12. Governing Law
These Terms and Conditions are governed by the laws of the State of Texas. Any disputes arising from these terms or your use of Fit-N-Wise services shall be resolved in the courts of Wise County, Texas.
